KlarCam

Terms

1. Subject

Sale of a license for the KlarCam software (Windows app and OBS filter) as digital content. The license has no time limit, is not transferable, and covers use by one person on that person's own devices.

2. Provider, payment and merchant of record

The provider and licensor of the software is WhenToTrade, owner Lars von Thienen, Bredbeekskoppel 6, 21266 Jesteburg, Germany (imprint); he is your contact for download, license key and support. Payment is processed through Stripe Managed Payments. Sold through Link, LLC (South San Francisco, USA), an affiliate of Stripe, acts as merchant of record toward you: Link collects the price, calculates and remits VAT or sales tax, issues your receipt and invoice, and handles refunds and payment disputes. The checkout shows the purchase as "Sold through Link", your card statement as "LINK.COM* CYCLESIQ". Link's buyer terms, linked in the checkout, apply to the payment in addition.

3. Contract

The contract is concluded when the payment in the checkout completes. The license key is shown right afterwards and sent by email.

4. Price

The price is a one-time price including the VAT of the country of delivery where applicable. There are no recurring charges.

5. Trial

The software can be used in full for 14 days from first use without a key. The trial runs once per computer; it does not start again with a later major version.

6. Scope of the license and updates

The key is valid for KlarCam 1: every 0.x and 1.x release, including bug fixes and updates, without a time limit. A later major version (2.0 and up) is not included and is sold as a separate purchase at its regular price; there is no upgrade discount. The major version a key covers is recorded in the key itself.

7. Warranty and liability

Statutory warranty rights apply. Liability for slightly negligent damage is limited to the foreseeable damage typical for the contract, except for injury to life, body or health.

8. Refunds

Refunds are made through Stripe/Link to the payment method used for the purchase. Write to hello@klarcam.com; you may also contact Link support directly. Link's buyer protection is unaffected.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer-protection provisions of the country of their habitual residence remain unaffected. For merchants, public-law entities and customers with no general place of jurisdiction in Germany, the exclusive place of jurisdiction is Jesteburg, Germany. This English version of the terms is binding; the German, Spanish and French versions are translations for convenience.

Right of withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving reasons. The period starts on the day the contract is concluded. To exercise it, inform us (WhenToTrade, Lars von Thienen, Bredbeekskoppel 6, 21266 Jesteburg, Germany, hello@klarcam.com) by an unequivocal statement, for example an email; you may use the model form below. Sending the statement before the period ends is sufficient.

Effects of withdrawal: we refund all payments received from you without undue delay and at the latest within fourteen days from the day we receive your withdrawal, through the payment method you used for the purchase; the refund is executed by Stripe/Link.

Early expiry: for digital content the right of withdrawal expires once you have expressly agreed that performance begins before the withdrawal period ends and have acknowledged that you thereby lose your right of withdrawal. You give this consent before the checkout through the checkbox on our buy page, because the license key is delivered at once; it is documented in the confirmation email that carries the license key.

Model withdrawal form (to withdraw, fill this in and send it to hello@klarcam.com): I hereby withdraw from my contract for the purchase of the KlarCam license. Ordered on: … Order number or email address of the purchase: … Name: … Address: … Date: …
